1. Our Company and Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of yiboshi-us.com (the "Site"), your purchase of products, and your use of related services provided by YIBOSHI ("we," "us," or "our"). By using the Site, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. 

2. Eligibility and Prohibited Uses

You must be at least 18 years old (or the legal age of majority in your jurisdiction) and legally capable of entering into a binding contract to use our services. By using our Site, you agree not to:

  • Use the Site, products, or services for any unlawful, fraudulent, or deceptive purpose.

  • Interfere with, disrupt, or compromise the security, integrity, or performance of our systems or the Site.

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site without our express written permission.

  • Transmit malware, viruses, or any other harmful code.

  • Engage in automated data scraping, crawling, or unauthorized commercial use of our content.

  • Infringe upon the intellectual property or privacy rights of others.

3. Product Information and Accuracy

We make every effort to ensure that product descriptions, specifications, images, pricing, and availability displayed on our Site are accurate and up-to-date. However, we do not guarantee that all content is error-free, complete, or current. Product packaging, labels, accessories, and color representation may vary slightly from the images shown on the Site. Screen colors, product packaging, software functions, and minor specifications may vary. In the event of any discrepancy between the information on the Site and the product packaging or user manual, the information on the physical product documentation shall prevail. We reserve the right to correct errors, update product information, adjust pricing, limit order quantities, and modify or discontinue any product at any time without prior notice.

4. Health and Medical Disclaimer

Product classification and intended use vary by model. Unless a specific product page and official labeling expressly state otherwise, do not assume that any YIBOSHI product is FDA cleared, FDA approved, or intended to diagnose, treat, cure, or prevent disease. Measurements can vary with posture, wrist fit, movement, environment, physiology, and device condition. Follow the user manual, use readings as directed for the specific model, and consult a qualified healthcare professional for medical decisions. For an emergency, contact local emergency services.

5. Orders and Acceptance

When you place an order on our Site, you will receive an order confirmation email acknowledging that we have received your order. This confirmation does not constitute our acceptance of your order. We reserve the right to:

  • Verify payment information, shipping details, and identity before processing any order.

  • Refuse, cancel, or limit orders for any reason, including but not limited to stock availability, pricing errors, suspected fraud or abuse, shipping address restrictions, or regulatory compliance.

  • Request additional information or documentation to confirm the legitimacy of an order.

If we cancel an order for which payment has already been processed, we will refund the affected amount to the original payment method.

6. Pricing, Payment, and Taxes

All prices displayed on our Site are in the currency selected at checkout and are subject to change without prior notice. The final price payable is the price shown at the time you complete your order. Applicable sales taxes, value-added taxes, customs duties, and shipping fees will be calculated and displayed at checkout before you confirm your payment.

We accept the payment methods listed on our Site at the time of purchase. By submitting your order, you authorize us and our payment service providers to charge the total amount shown at checkout. All payments are subject to authorization from your payment provider, fraud screening, and currency conversion fees (if applicable). For your security, please never send full credit card numbers, CVV codes, or other sensitive payment information via email or unencrypted channels.

7. Shipping and Delivery

Shipping is governed by our Shipping Policy. Delivery dates are estimates, not guarantees, unless expressly stated. Risk of loss transfers as required by applicable law. If an order is lost or damaged in transit, contact us promptly at support@yiboshi-us.com so we can investigate and provide the appropriate remedy.

8. Returns, Refunds, and Warranty

Returns and refunds are governed by our Refund Policy. Covered product defects are governed by our 12-Month Limited Warranty. Digital services, activated software upgrades, wholesale orders, and other special products may have additional or different terms disclosed before purchase.

9. Accounts and Communications

You are responsible for maintaining accurate account information and protecting account credentials. You consent to receive transactional communications relating to orders, support, security, and service. Marketing messages are sent in accordance with your choices and applicable law.

10. Intellectual Property

The Site, brand names, logos, text, graphics, product images, videos, software, designs, and other content are owned by or licensed to YIBOSHI and protected by intellectual property laws. No rights are granted except the limited right to use the Site for personal, lawful shopping and support purposes.

11. Reviews, Feedback, and User Content

If you submit a review, photo, video, comment, or feedback, you confirm that it is truthful, based on your experience, lawful, and does not infringe others' rights. You grant YIBOSHI a non-exclusive, worldwide, royalty-free license to display, reproduce, and adapt the submitted content for store, support, and marketing purposes, subject to applicable privacy law. We do not require positive reviews and may moderate content for fraud, abuse, privacy, illegality, or irrelevance.

12. Third-Party Services and Links

The Site may contain services, applications, or links provided by third parties. Their terms and privacy practices apply to their services. YIBOSHI is not responsible for third-party content or services except as required by law.

13. Disclaimer of Warranties

Except for our written Limited Warranty and rights that cannot be excluded by law, the Site and services are provided on an "as available" basis. We do not guarantee uninterrupted operation, perfect compatibility, or that all information will always be error-free. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be limited.

14. Limitation of Liability

To the maximum extent permitted by law, YIBOSHI will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the Site or products. Our aggregate liability for a claim will not exceed the amount paid for the affected product, except where applicable law requires otherwise or liability cannot be limited.

15. Governing Law and Disputes

These Terms are governed by the laws of China, without excluding mandatory consumer protections that apply to you. Before filing a formal claim, please contact support@yiboshi-us.com so the parties can attempt to resolve the issue. 

16. Changes and Severability

We may update these Terms by posting a revised version. If any provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver.
